With setback restrictions.

All tracts 1 to 60, except tracts 52, 53 and 60, of _________ subdivision, shall be known and described as residential tracts and shall be used for no other purpose than for single-family dwellings, for private garages, and for necessary and appurtenant outbuildings.

No structure shall be erected, altered, placed or permitted other than one detached single-family dwelling, and a private garage not to exceed one story in height for not more than three cars, and a guest house or servant quarters for the sole use of nonpaying guests or servants of the occupants of the main dwelling.

All buildings shall be located in conformance with the terrain, provided, however, that no dwelling shall be located nearer than 20 feet to the front property line nor nearer than 10 feet to any side street line, except with the written approval of the architectural committee. No dwelling, detached garage or other building shall be located nearer than 5 feet to any side or rear tract line, and no dwelling shall be erected or placed on any residential building plot, other than on an entire tract as shown on the map. For the purpose of these conditions any parcel under one ownership, incorporating parts of two adjoining tracts, or all of one tract and a part or parts of adjoining tracts, shall be deemed to be a single tract.

The conditions, are and shall be covenants running with the land and a breach or violation of them or the continuance of any breach or violation may be enjoined, abated or remedied or damages may be recovered by appropriate proceedings by the trustee, its successors or assigns, or by any owner or owner's successors in interest.

"When an estate development is going through the process of basic planning, general decisions will be taken as to layout in consultation with local government with particular reference to the road system and general infrastructure. When it comes to recruiting builders to undertake site work, all the general architectural limitations will be passed on, e.g. where buildings can be erected in relation to the road system, how many cars may be garaged, etc. These conditions will both affect the initial building work and will run with the land as the plots are sold. This type of clause captures the detail of these limitations and covenants as a part of the process of attaching them to the land as it is parcelled out and developed. It will always have to be customized to match the particular facts and to reflect decisions on phasing the development which may specifically exclude some plots from the immediate development or from the operation of some or all the covenants."
