A general form.

A is the owner of land in _________, more particularly described below, and B is the owner of adjoining land. A and B have agreed upon a right-of-way for a road across the land of A in favor of B and in favor of the land of B.

It is agreed between A and B this _________ day of _________[month], _________[year] that:

1. A, in consideration of the agreement made by B, grants to B a right-of-way for a road over the land of A in _________, more particularly described as follows: _________, the right-of-way to be _________ feet in width and to be from _________ in a _________ course to _________.

2. The right-of-way is to be an easement over the land of A for the use and benefit of B and of the land of B in _________, more particularly described as follows: _________.

3. A, at A's expense, will defend the right-of-way against anyone claiming it or in any manner preventing free and unobstructed use of it by B.

4. B, in consideration of the grant of the right-of-way agrees to pay A the sum of _________ dollars, payable as follows: _________.

5. This agreement shall inure to and bind the heirs, executors, administrators and assigns of the parties, and shall constitute a covenant running with the lands of A and B.

"I hadn’t realized it was so easy to create a right of way. I was expecting some megadoc, pages long. This easement was a breeze. Just changed it around some to make it fit. It’s for me to walk over my neighbor’s yard as a shortcut not build a road. "

"The detail of creating a valid easement differs slightly from state to state. If in doubt, get local advice. In general, an easement for a right of way is considered appurtenant to the dominant tenement and it is exercised over the servient tenement, the land next door over which you walk or drive when you exercise the right of way. You can use more or less any words so long as the meaning is clear, i.e. the owner of the servient land accepts the right of the owner of the dominant land to exercise the right. It is also possible to get an easement in gross which is a personal right rather than a right tied to the title of land. In both cases, safety first requires you to register the right. Many states have land registration systems. Placing a record of the easement against the title protects the dominant owner. It takes a court order to remove the registered easement unless the dominant owner consents. Failure to register can lead to problems unless a credible third party can give evidence that the right was created and exercised."
