Bequest as consideration.
This agreement made and entered into [date] between A,
and B and C, jointly.
A is a single man [woman] and is residing at this time
in the home of B and C at _________.
It is the intention of A to make his [her] home with B
and C upon the conditions set out, and it is agreed by the parties as follows:
In consideration of the sum of $_____, to B and C paid
by A, the receipt of which is acknowledged, and in the further consideration of
the undertakings of A, B and C agree that during the lifetime of A, or for that
term set out, they will furnish a home for A in their home in _________,
treating A as a member of the family, the meaning of which is that they will
furnish him [her] food, laundry, bedclothes and afford him [her] access to
parts of the house as he [she] may desire except their bedroom, and give him
[her] free run of the property, except that he [she] is not to have any part in
the management of the property.
A shall pay to B and C $_____ per month during the
time he [she] lives with them and during the term of this contract.
This contract is to last during the life of A and in
the event B and C have furnished the above items and services, A does agree
that upon his [her] death he [she] will have by will provided and here
represents he [she] will have available for payment, the sum of $_____ to B and
C, jointly, as husband and wife, and he [she] represents that he [she] has this
same day executed a will leaving these parties the sum of $_____ conditioned
upon their faithful performance of this agreement.
In the event that during the lifetime of this
contract, A's physician shall advise him [her] that for his [her] best care and
treatment he [she] should be confined to a hospital or other facility, then
that event shall not be a violation of the obligations of B and C.
Either party may cancel this contract at any time they
desire; however, in the event A cancels this contract, A shall be obligated to
pay for the time he [she] has been in the home of B and C, at the rate of
$_____ per month.
