"I will answer Amanda's questions so that those who follow will understand why the form is drafted in this way. Mediation is negotiation under a different name. No judge is there to make a decision. It is up to the parties to reach their own agreement if they can (there is a court appointed mediator present to offer advice). Going before a judge creates winners and losers. This can destroy goodwill between the parties. It is always better if they can sort out their problems without seeing a judge. Similarly, the last clause encourages the parties to renegotiate the agreement if there is a change of circumstances. In all this, the interests of the children should be everyone's first concern. Parents should sacrifice their own pride and make the best decisions in the new situation. Again, going before a judge should be the last resort should mediation fail."
