Failure to perform.
[Add introductory clause as in §5.6506.]
(a). Failure of Borrower to comply with the covenants
of Sections _________ of this Loan Agreement or to maintain the ratio required
by Sections _________ as of the end of any fiscal quarter; (b) failure of
Borrower to comply with any other term of this Loan Agreement which is not
specifically addressed in this Section or to perform when due any other
obligation of Borrower to Bank under this Loan Agreement which is not
specifically addressed in this Section, and such failure is not cured within
_________ days after notice of that failure from Bank to Borrower, provided
that with respect to failures which cannot be cured by the payment of money and
which due to their nature cannot be cured within the _________-day period,
Borrower shall not be in default so long as Borrower commences to cure the
default within that _________-day period, diligently pursues the cure, and
effects the cure within such longer time as acceptable by Bank not to exceed
_________ days after the original notice; or (c) the occurrence of an event of
default under any note given pursuant to this Loan Agreement or any other Loan
Document or other instrument given by Borrower to Bank.
